On April 28, 2024, the Board of Supervisors of San Francisco made significant changes to the city's regulations concerning Unauthorized Dwelling Units (UDUs) in single-family homes. The amendments, detailed in the San Francisco Planning Code, aim to address the issue of unauthorized units within the city.

According to the new legislation, individuals seeking to remove a UDU from their single-family home will now have to meet specific criteria to qualify for an exemption from obtaining Conditional Use Authorization. One of the key requirements includes the owner residing in the primary dwelling unit at the time of the application for UDU removal.

Furthermore, the legislation states that the UDU should not have been rented out for consideration in the last decade, except to a qualifying family member as defined in the law. Additionally, owners planning to remove a UDU must commit to living in the single-family home for a minimum of three years post-approval of the removal.

Moreover, property owners are now obligated to enter into a regulatory agreement with the City, ensuring that the single-family home remains subject to local rent control under the San Francisco Rent Ordinance permanently.
